1. Introduction

Welcome to Suvé. These Terms of Service ("Terms") govern your access to and use of the Suvé website, mobile site, and any related services (collectively, the "Platform"), operated by Naaksh Web Solutions Pvt Ltd ("Suvé", "we", "us", "our"), having its registered office at B.C Sen Road, North Tarapukur, North 24 Parganas, Agarpara, Kolkata 700109.

By accessing, browsing, or placing an order on the Platform, you ("user", "customer", "you") agree to be bound by these Terms, along with our Privacy Policy, Shipping Policy and Return & Exchange Policy, all of which are incorporated herein by reference. If you do not agree with these Terms, please do not use the Platform.

2. Eligibility

By using the Platform, you confirm that:

You are at least 18 years of age, or are using the Platform under the supervision of a parent/legal guardian.
You have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872.
Information you provide to us is accurate, current, and complete.

We reserve the right to refuse access to the Platform or cancel orders where eligibility criteria are not met.

3. Account Registration

You may be required to create an account to place orders, using accurate details such as name, email, phone number, and delivery address.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Suvé is not liable for any loss or damage arising from your failure to protect your account information.
We reserve the right to suspend or terminate accounts found to be fraudulent, inactive, or in violation of these Terms.

4. Products & Pricing

4.1 Product Listings

We make every effort to display product images, descriptions, and details as accurately as possible. However, actual product colour, shape, size, and finish may vary slightly from images due to lighting, screen settings, or the handcrafted nature of the product.
We reserve the right to modify, discontinue, or update product listings, descriptions, and availability at any time without prior notice.

4.2 Pricing

All prices listed on the Platform are in Indian Rupees (INR) and are inclusive of applicable taxes (GST), unless stated otherwise.
We reserve the right to change prices at any time without prior notice. The price applicable at the time of order confirmation will be the final price charged.
In the event of a pricing error (technical glitch, typographical error, etc.), we reserve the right to cancel the order and issue a full refund, even if payment has been processed.

4.3 Offers & Discounts

Promotional offers, discount codes, and sale prices are valid only for the specified period and subject to applicable terms and conditions communicated at the time of the offer.
Offers cannot be combined unless explicitly stated and are subject to change or withdrawal without prior notice.

5. Orders

5.1 Order Placement

Placing an order on the Platform constitutes an offer to purchase the product(s), which is accepted by Suvé upon order confirmation (via email/SMS) and successful payment realisation.

5.2 Order Cancellation by Suvé

We reserve the right to cancel any order, at our sole discretion, in cases including but not limited to:

Unavailability or out-of-stock products.
Errors in product pricing or description.
Suspected fraudulent transactions or violation of these Terms.
Inability to deliver to the specified address.

In such cases, any amount paid will be refunded in accordance with our Refund Policy.

5.3 Order Cancellation by Customer

Orders may be cancelled by the customer only before the order has been dispatched. Once shipped, cancellation is not possible, and the order will be subject to our Return & Exchange Policy upon delivery.

6. Shipping, Returns & Payments

Shipping timelines, charges, return/exchange eligibility, and payment terms are governed by our respective Shipping & Delivery Policy, Return & Exchange Policy, and Payment Policy, available on the Platform, and form an integral part of these Terms.

7. Intellectual Property

All content on the Platform — including but not limited to the Suvé name, logo, trademarks, product designs, images, text, graphics, and website layout — is the exclusive property of Suvé and is protected under applicable Indian intellectual property laws.
You may not reproduce, copy, distribute, modify, or create derivative works from any content on the Platform without our prior written consent.
Unauthorised use of any content may result in legal action.

8. User Conduct

You agree not to:

Use the Platform for any unlawful purpose or in violation of these Terms.
Post or transmit any content that is defamatory, obscene, infringing, or harmful.
Attempt to gain unauthorised access to the Platform, its servers, or any connected systems.
Use any automated means (bots, scrapers) to access or extract data from the Platform without permission.
Engage in fraudulent transactions, including the use of stolen payment credentials.

Violation of these terms may result in suspension or termination of your account and/or legal action.

9. Reviews & User-Generated Content

By submitting a review, photo, comment, or other content on the Platform, you grant Suvé a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display such content for marketing and promotional purposes.
We reserve the right to remove any content deemed inappropriate, misleading, or in violation of these Terms.

10. Limitation of Liability

Products sold are intended for personal, non-commercial use only.
Suvé shall not be liable for any indirect, incidental, or consequential damages arising from the use of, or inability to use, the Platform or products purchased therein.
While we take care in packaging and quality checks, minor variations inherent to handcrafted jewellery (e.g., stone placement, finish) do not constitute a defect.
Our total liability for any claim arising out of your use of the Platform shall not exceed the amount paid by you for the relevant order.

11. Third-Party Links & Services

The Platform may contain links to third-party websites, payment gateways, or services. Suvé is not responsible for the content, accuracy, or practices of such third parties, and your interactions with them are governed by their respective terms and policies.

12. Indemnification

You agree to indemnify and hold harmless Suvé, its affiliates, officers, employees, and partners from any claims, damages, losses, or expenses (including legal fees) arising out of your breach of these Terms, misuse of the Platform, or violation of any applicable law.

13. Force Majeure

Suvé shall not be held liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, pandemics, government restrictions, courier disruptions, or technical failures.

14. Modifications to Terms

We reserve the right to modify, update, or replace these Terms at any time without prior notice. Continued use of the Platform after such changes constitutes your acceptance of the revised Terms. We recommend reviewing this page periodically.

15. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Kolkata, West Bengal.
